Fox Business co-host Jackie DeAngelis has sued Whole Foods, saying a black pit bull that was not a service animal attacked her inside one of the chain’s New York City stores in 2023, tore into her left hand, and left her permanently disfigured even after surgery.

The complaint, filed last month in Manhattan Supreme Court, says store policy bars ordinary pets and allows only ADA service animals, that this dog did not qualify, and that Whole Foods “failed to reasonably enforce its own policies, practices and/or procedures concerning animals entering and remaining within the subject store.”

“Prior to the attack, plaintiff did not provoke, threaten or otherwise engage the subject dog in any manner that caused or contributed to the occurrence,” the complaint states.

“As a result of the attack and dog bite, plaintiff sustained severe and permanent personal injuries.”

“The subject dog was present within the store for a sufficient period of time and under such circumstances that defendant, in the exercise of reasonable care, should have discovered its presence prior to the attack upon plaintiff,” DeAngelis said in the legal filing, according to a report from Mediaite.

By the time police arrived, the dog and its owner were gone.

DeAngelis, 46, co-host of The Big Money Show, says she has limited mobility, cannot do certain tasks, and faces ongoing medical bills and emotional distress.

“Plaintiff’s injuries and resulting damages are permanent and continuing in nature,” the lawsuit alleges. It says she is “unable to perform her usual activities and duties for periods of time and may continue to suffer limitations in the future.”

She is seeking unspecified damages.

Whole Foods has not publicly commented on the lawsuit.
