Opinion: The People can undertake amending the Constitution without involving the Congress or calling for an all-powerful Convention of States;


There is a passion Americans share regarding our founding documents, which is why study is necessary to fully understand them, public education having failed by not arming younger generations with knowledge.

With Idaho rejecting the Convention of States this month, there are twenty states that have signed-on to the concept. It’s imperative to address why a constitutional convention may not benefit this union.


But is there an Article V alternative? The answer is “yes”

Many say “no” to a Convention of States due to a well-founded fear in who would represent the People as delegates. The rationale is plainly demonstrated by Senate GOP leadership’s refusal to pass the SAVE America Act, despite 84% of the American people resoundingly in favor of instituting voter I.D., and other election integrity measures such as paper ballots, cleaning up voter rolls, etc.).

How could citizens believe that delegates, chosen by establishment (and untrustworthy) state legislators to represent them at a constitutional convention, wouldn’t do exactly what Congressional republicans have been doing? Which would be disregarding the expressed will of the people to enact one or two amendments without damaging, or ultimately destroying the matrix of this republic—the Constitution?

The First and Second Amendment that limits government from interfering with our core unalienable rights would be at risk from pretenders filling the delegation.

Republicans in office are proving over and over that they have priorities other than preserving the integrity of the United States of America, as they constantly kowtow to donors that insist on illegitimately sheltering, funding, and giving voice to illegal aliens. They also give cover to anarchists, criminals, and unconstitutional sharia law that islam is determined to entrench, superseding our Law of the Land.

No, a Convention of States is far too critical and overarching an endeavor to allow the future of this nation be handed to irresponsible, self-serving, paid-off politicians.

But is there an Article V alternative?

The answer is “yes.”

Going back to thoroughly researched columns penned by our legal researcher, Toddy Littman, fifteen years ago, this information is game-changing for proponents of amending the Constitution to address limited issues. There is a route that does not begin with Congress or the necessity to call a precarious COS.

Clarifying how the right result can be achieved in amending the Constitution, Toddy laid out the history of the writing of Article V via references to the Federalist Papers and other later writings of the signers.

It is interesting to go through the breakdown of Article V with the grammatical notations (note how language changes over time, e.g. the term ‘nice’ woman in Elizabethan-Jamesian nomenclature meant a guttersnipe, prostitute) to clarify each clause. This includes the fact that the last clause is wholly separate and unrelated to the foregoing reference to 1808 which stands alone, semi-colons on either side of the clause—this is the clause added by Roger Sherman who had concern that the smaller states (governments) could lose their voice: “and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate." (1)

Article V, in fact the Constitution on the whole, was written delineating the powers allotted to government by the People, the sovereigns, not the opposite. Article V states how amendments and conventions are called through the national (federal) government. Note that it doesn’t provide for the People’s ability to amend the Constitution, as being unnecessary because the People already have the unalienable, inherent right to do so.


The switching of language from ‘Constitutional Convention’ to ‘Convention of States’

That a Convention of States, assembly or whatever other body, may be called by the people is not mentioned because it was unnecessary as already assumed. The following quote from Toddy’s (ChangingWind: The "Con-Con" Con-I ) pretty well covers the point:

    “Governments and their magistrates are not the people and are not even representative of the people when it comes to assuring the Will of the People is done to the people's satisfaction. A perfect example would be the numerous State Constitutions at the founding of the nation that were rejected by the people on the grounds they had been drafted and ratified by legislatures for their own ends and not the people themselves.”

    See where Toddy is going? He is showing how the original articles of the Constitution were crafted and how We, the People, need to be reminded of our power.

If citizens are intent on amending the Constitution for issues such as balanced budgets and term limits, proposals can be crafted by a carefully selected or elected committee created for this purpose. The finalized amendment is then submitted to each state legislature directly for ratification. This pathway empowers citizens while protecting the document’s original foundation from faux constitutionalists’ deceit.

The switching of language from ‘Constitutional Convention’ to ‘Convention of States’ was the first move in misleading possible supporters, that they would underestimate the power of the delegates. Called together with the Constitution open at their feet to protect or erode, they could deconstruct the foundations of this nation.


Human nature is such that individuals refuse to admit they are wrong. They get dug-in to an opinion because reversal challenges their confidence and pride. Until we study and undergo the necessary changes of heart (biblical repentance) realizing it to be an ongoing process, we will continue the downhill slide toward losing this country.

The Constitution is a document of incredible, anointed design that is the result of decades of struggle by our forebears who knew true oppression, from which we have been far removed. The People can undertake amending the Constitution without involving the Congress or calling for an all-powerful Convention of States, otherwise known as a Constitutional Convention. They are one and the same.
